Effective 28 September 2026 · Version 1.0
These Terms and Conditions ("Terms") constitute an electronic record within the meaning of the Information Technology Act, 2000 and the rules made thereunder, and are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This electronic record is generated by a computer system and does not require any physical, electronic or digital signature.
These Terms constitute a legally binding agreement by and between you ("you", "your" or "User") and Pitta ("Pitta", "we", "us" or "our"), and govern your access to, installation of, registration upon and use of the Platform and the Services. By accessing, installing, registering upon or otherwise using the platform, you irrevocably and unconditionally represent, warrant and covenant that you have read, understood and agree to be bound by these terms in their entirety. If you do not so agree, you must forthwith desist from all access to and use of the platform.
.1 Capitalised terms not otherwise defined herein shall bear the meanings ascribed to them in the Privacy Policy, which is incorporated herein by reference. "Applicable Law" bears the meaning set out therein; "Platform", "Services", "User Content" and "Third-Party Brands" are likewise as defined therein.
.2 Headings are for convenience only; the singular includes the plural and vice versa; and "include" and "including" are without limitation.
.1 These Terms, together with the Privacy Policy and any supplemental or product-specific terms, policies and guidelines published upon the Platform (all as amended from time to time), constitute the entire agreement between the parties in respect of the subject matter hereof and supersede all prior understandings, whether oral or written. In the event of any conflict, these Terms shall prevail save where a supplemental term expressly stipulates otherwise.
.1 You represent and warrant that you are a natural person of not less than eighteen (18) years of age and otherwise competent to contract within the meaning of the Indian Contract Act, 1872. Where you act on behalf of a business, you further represent and warrant that you are duly authorised to bind such business to these Terms.
.1 Subject to your continuing compliance with these Terms, Pitta hereby grants to you a limited, revocable, non-exclusive, non-transferable, non-sub-licensable and personal licence to access and use the Platform solely for its intended purposes. All rights not expressly granted herein are reserved. You shall not, and shall not permit any third party to, reverse engineer, decompile, disassemble, scrape, replicate, resell or create derivative works from any part of the Platform, save to the extent such restriction is prohibited by Applicable Law.
.1 Your account is constituted by your mobile telephone number, verified by a one-time passcode. You are the person in control of that number. One device may be authenticated per customer number at any given time, and a subsequent authentication shall de-authenticate the antecedent device. You shall maintain the confidentiality and security of your device, credentials, API keys and webhook secrets, and you acknowledge and agree that any act or omission effected through your account or by use of your key shall be conclusively deemed to have been effected by you, and you shall be solely liable therefor.
.1 You acknowledge that orders and bookings placed through the Platform constitute contracts by and between you and the relevant business; that Pitta carries the messages and records the status thereof in the capacity of an intermediary and does not sell, supply, deliver, warrant or hold payment for the underlying goods or services; and that all matters pertaining to price, availability, quality, delivery, fulfilment, cancellation and refund of such goods or services lie exclusively between you and such business.
.1 The Platform is presently made available to businesses free of charge; we reserve the right to introduce chargeable features prospectively, without any pre-existing feature becoming chargeable absent notice. A business shall: (a) message only persons who follow it or who have affirmatively accepted its request, and upload only audience lists comprising persons who have consented to be contacted; (b) be solely responsible for its broadcasts, listings, prices, and the fulfilment of the orders and bookings it accepts, and for its compliance with all Applicable Law; and (c) refrain from the dissemination of unsolicited communications, failing which its account may be suspended or terminated.
.1 Brand gift cards are sold by Pitta and issued through our voucher partner. A gift card that cannot be issued shall be refunded to the original instrument of payment. Once issued, a gift card is non-returnable and non-refundable and shall be usable strictly in accordance with the terms, validity and conditions stipulated by the issuing proprietor, which terms are established by such proprietor and not by Pitta.
.1 Payments in respect of gift cards are processed by our third-party payment processor. We do not receive or store your full card number, card verification value or unified-payments-interface personal identification number. Refunds, where due, shall be remitted to the original instrument of payment and may require a reasonable number of business days to reflect, contingent upon your bank or payment service provider. In respect of goods and services supplied by a business, such business shall bear sole responsibility for pricing, invoicing, taxation and refunds.
.1 You covenant that you shall not, directly or indirectly: (a) transmit any content that is unlawful, defamatory, obscene, deceptive, harassing, infringing or otherwise objectionable, or that violates the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; (b) impersonate any person or misrepresent your affiliation; (c) transmit unsolicited or bulk communications to persons who have not opted in; (d) collect, harvest or misuse the data of other Users; (e) introduce any virus, malware or deleterious code, or probe, scan, overload, disrupt or attempt unauthorised access to the Platform or its infrastructure; or (f) use the Platform in contravention of any Applicable Law.
.1 The Platform interoperates with third-party services, including our payment processor (Razorpay), our voucher partner (Hubble) and third-party cloud and notification providers (including Google/Firebase). Your use of any such feature may additionally be subject to the terms and policies of the relevant third party, and Pitta shall bear no liability in respect of any third-party service beyond its reasonable control.
.1 To the fullest extent permissible under applicable law, the platform and the services are provided on an "as is" and "as available" basis, without warranties, representations or conditions of any kind, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy or non-infringement. We do not warrant that the Platform shall be uninterrupted, timely, secure, or free from error, defect or malicious code.
.1 To the fullest extent permissible under applicable law, in no event shall pitta, its affiliates, directors, officers, employees or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or business, howsoever arising, whether in contract, tort (including negligence) or otherwise, even if advised of the possibility thereof. Without prejudice to the generality of the foregoing, Pitta shall not be liable for goods or services supplied by businesses upon the Platform, nor for the terms of gift cards established by the issuing proprietors. The aggregate liability of Pitta arising out of or in connection with these Terms shall not exceed the greater of the amounts actually received by Pitta from you in the three (3) months immediately preceding the event giving rise to the claim, or Indian Rupees One Thousand (INR 1,000). Nothing herein shall exclude any liability that may not lawfully be excluded.
.1 You shall indemnify, defend and hold harmless Pitta and its affiliates, and their respective directors, officers, employees and agents, from and against any and all claims, demands, actions, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with (a) your breach of these Terms or any Applicable Law; (b) your User Content; or (c) your use or misuse of the Platform.
.1 Pitta shall not be deemed to be in breach of these Terms, nor liable for any failure or delay in performance, to the extent occasioned by any event beyond its reasonable control, including acts of God, natural calamity, epidemic or pandemic, war, terrorism, civil disturbance, governmental action, failure of telecommunications or internet infrastructure, power outage, or failure of any third-party service provider (a "Force Majeure Event").
.1 These Terms shall remain in force for so long as you access or use the Platform. We may, at our sole discretion and with or without notice, suspend, restrict or terminate your access where you breach these Terms or Applicable Law, or where we are required to do so, and we shall ordinarily communicate the reason therefor. You may cease use at any time and delete your account through Settings → Delete account. The provisions which by their nature ought to survive termination, including Clauses 11, 13, 14, 15, 18 and 19, shall so survive.
.1 The parties shall first endeavour to resolve any dispute, controversy or claim arising out of or in relation to these Terms amicably through good-faith negotiation. Failing amicable resolution within thirty (30) days, such dispute shall be referred to and finally resolved by arbitration conducted by a sole arbitrator appointed by Pitta, in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat and venue of arbitration shall be in India, the language of the arbitration shall be English, and the award of the arbitrator shall be final and binding upon the parties, subject to any non-derogable rights conferred upon consumers by Applicable Law.
.1 These Terms shall be governed by and construed in accordance with the substantive laws of India, without regard to any conflict-of-laws principle. Subject to Clause 18, the courts of competent jurisdiction in India shall have exclusive jurisdiction, without prejudice to any non-derogable statutory rights you may possess.
.1 Severability. Should any provision hereof be adjudged invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the impugned provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable.
.2 Waiver. No forbearance, delay or indulgence by Pitta in enforcing any provision hereof shall operate as, or be construed to be, a waiver thereof.
.3 Assignment. You shall not assign or transfer any of your rights or obligations hereunder without our prior written consent; Pitta may freely assign these Terms in connection with any merger, acquisition, reorganisation or sale of assets.
.4 Amendment. We reserve the right to modify these Terms at any time; the revised date shall be reflected above, material variations shall be notified within the application, and your continued use shall constitute acceptance.
.5 Notices & grievances. Notices and grievances may be addressed to the Grievance Officer at hello@pitta.pro, by telephone to +91 94919 99998, through the official Pitta channel within the application, or via the business portal at app.pitta.pro. See also our Privacy Policy and the support page.
